Occupational Safety and Health Risk Management Regulations

Category: Safety & Health β€’ Posted: Jan 29, 2026

Introduction

Under the Occupational Safety and Health Act (OSHA) 1994, it is the responsibility of both employers and their workers to ensure safety and health at the workplace and those who fail to do so could be charged in court. Employers and contractors who fail to provide a safe and healthy working environment for their employees can be charged under Section 15 of OSHA 1994, which carries a maximum sentence of a RM50,000 fine, or two years’ jail, or both. In recent years, Hazard Identification, Risk Assessment and Risk Control (HIRARC) has become fundamental to the practice of planning, management and the operation of a business as a basis of risk management. The organizations that have carried out risk assessment at the workplace have noted numerous changes in their working practice. Those who have already carried out risk assessment in their work, have reported positive changes in their working practice, they recognize substandard acts and working conditions as they develop and take necessary corrective action. Legislation requires that this process should be systematic and be recorded so that the results are reliable and the analysis complete. The risk assessment process should be continuous and should not be regarded as a one-off exercise. In line with the Department of Occupational Safety and Health approach of PREVENTIVE MEASURES as a way of enforcing the law on Occupational Safety and Health (OSH), it seems that OSH Risk Management has become extremely important. With OSH Risk Management, one will be able to identify hazard, analyze and assess its associated risk and then apply the suitable control measures This training addresses the content of Industry Code of Practice (ICOP) OSH Risk Management Regulations 202X and provides guidance towards compliance to the Occupational Safety and Health (Occupational Safety and Health Risk Management) Regulations 202X. This ICOP should be simple enough to be used by organizations and should be versatile enough to be used by all in various economic sectors, either in the manufacturing sector, construction sectors or any other economic sectors.
